Stu’s View Fees and Credits Policy
Welcome to Stusview.com! If you are the owner, leasing agent, manager or broker of a rental Property (“User”) you hereby agree to the following terms and conditions which shall apply to any Property (single family home, apartment or condominium or other living accommodations) you input for rent on Stu’s View:
Referred Lease. You will pay to Stusview.com a success fee of $375.00 for each "Referred Lease." A Referred Lease is defined as an occurrence where a Renter (a) finds your Property advertised on the www.stusview.com website (the "Website"); (b) enters into a lease for a unit in the Property or any other unit offered in the building or apartment/condominium complex to Renter by you which the Renter rents; and (c) moves into the Property.
Stu’s View has a Reward Policy for Renters (see Stusview.com Renters Reward Policy on this Website). In the Stusview.com Reward Policy, Stusview.com directs Renters to tell you that they found the Property on Stusview.com and instructs them to write "Stusview.com" as their source on guest cards and/or lease applications. This is one of many ways for the parties to confirm the entry into a lease. Importantly, however, it is not the only evidence that can establish that the Renter found the Property on Stusview.com. Accordingly, even if Stusview.com is not noted as the source by the Renter, you shall remain responsible for the payment of the success fee if there is other reasonable evidence (such as tracking data) that the Renter found the Property on or was directed to you from Stusview.com.
Fees. There is no charge for you to advertise your Property on the Website. You will be obligated to pay to Stusview.com a success fee, which equals $375.00 per Referred Lease, unless otherwise stated herein (the "Fee"). You must pay the success fee for such Referred Lease within thirty (30) days after the Renter's move-in date or the date on which the Renter reports the lease, whichever comes later.
Discounted Fee. If Renter or User notifies Stu’s View in writing via the Website within seven (7) days of the lease signing by Renter and User, Stu’s View will “discount” its success fee to $350.00. This invoice must be paid by User within thirty (30) days or the discounted rate shall not apply and User shall be charged the full $375.00 rate.
Other. If the original term for the Referred Lease is 3 months or less, the success fee shall be $175.00. In the event the Property changes its manager or is sold, you will notify us within ten (10) days after the management change or sale. You will remain liable for all success fees attributable to Referred Leases after such management change or sale unless you provide evidence that the new manager or owner has assumed the liability for such Referred Leases. In the event you remove your Property from Stu’s View, you will remain liable for all success fees attributable to Referred Leases for sixty (60) days after the effective date of such Property removal. In the event that one advertisement results in more than one Referred Lease, there will be a success fee for each Referred Lease.
Stusview.com will invoice you for each success fee, which you shall pay per the terms of the invoice. The success fee must be paid within thirty (30) days of invoice by Stu’s View or interest will be charged at a rate of 1.5% per month, or the highest rate allowed by applicable law, whichever is lower. If you believe there is an error on the invoice, please notify us within such 30-day period; if you fail to notify us within such 30-day period, the invoice will be deemed accurate, valid and an account stated. In the event a Renter does not move into the Property and “breaks” its signed lease and does not move into the Property identified in the lease or any other unit within the same building or complex and you notify Stu’s View within thirty (30) days of such failure to move into the Property by the Renter, Stu’s View will refund the success fee paid by you to Stu’s View.
Renters $125 Reward. “New” Renters (see Reward Policy) who sign a lease with you and move into the Property for a Property registered under this program and then notify Stusview.com may qualify to receive a $125.00 Reward or other valuable consideration from Stusview.com. See Stusview.com's Reward Policy. There is no charge for a Renter to search for properties on Stusview.com; however, Renters must create a registration account. There is no charge for such registration.
General. Stu’s View reserves the right to insert or remove User contact information without notice to or consent of User. Users are prohibited from rating their own properties. Stu’s View reserves the right to remove any advertisement of User should User directly or indirectly enter a rating for User’s Property. Stusview.com reserves the right to change these fees at any time with 30 days notice by posting those changes on the www.stusview.com Website; however, no notice will be required for a reduction in fees. Stusview.com may choose to temporarily change this Fees and Credits Policy and the fees for services provided for promotional events, and such changes are effective when Stusview.com posts the temporary promotional event on the site. Stusview.com maintains sole discretionary right to change some or all of its services at any time. In the event that Stusview.com introduces a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in U.S. dollars. Users are responsible for paying all fees associated with using the Stusview.com service and with using Stusview.com's Website, and for all applicable taxes.
Indemnification. User hereby agrees to indemnify and hold Stu’s View harmless from any and all claims, demands, investigations, judgments, settlement with fair housing authorities or otherwise, including the payment of reasonable attorney fees and costs to legal counsel of Stu’s View’s choice, which may arise as a result of any input by User onto the Website or any actual or alleged violation or any federal, state or local fair housing law arising from the input to the Website by or actions of User.
Users shall agree and do hereby agrees to comply with all Federal, State and local Fair Housing statutes and ordinances, as applicable to their Properties advertised.
